  1. Introduction

This document ("Agreement") sets forth the terms and conditions that apply to the use of the website located at www.alfi-home.com ("the Site"), which is owned and operated by ALFI-Home ApS, a company registered under the laws of Denmark with CVR number 44203782 and Tax ID DK44203782 ("the Company"). By accessing the Site, you agree to be bound by these terms and conditions and all applicable laws and regulations governing the Site. If you do not agree with any of these terms, you are prohibited from using or accessing the Site.

  1. User Agreement

By using the Site, you ("User" or "You") agree to these terms and conditions. You affirm that you are of legal age to enter into this Agreement and are fully able and competent to satisfy the terms, conditions, and obligations herein. The use of this Site is subject to the following terms of use:

  • Account Eligibility and Registration Requirements: You may be required to register on the Site to access certain features. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • User Responsibilities: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
  1. Product Information

The Site offers high-quality jaw exercisers ("Products") designed to strengthen and define the jawline. The Company makes every effort to display as accurately as possible the colors, features, specifications, and details of the Products available on the Site. However, the Company does not guarantee that the colors, features, specifications, and details of the Products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colors and details of the products.

  1. Intellectual Property Rights

The Site and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors. The Site is protected by copyright, trademark, and other laws of both Denmark and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

  1. Order Placement and Acceptance

You may place an order by following the online shopping process on the Site. After placing an order, you will receive an email from the Company acknowledging that the Company has received your order ("Order Confirmation"). Please note that this does not mean that your order has been accepted.

Your order constitutes an offer to the Company to buy a Product. All orders are subject to acceptance by the Company, and the Company will confirm such acceptance to you by sending you an email confirming the shipment of your order ("Shipping Confirmation").

  1. Payment Terms

Payment processing services for goods and services purchased on the Site are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement").

By agreeing to these terms and conditions or continuing to operate as a user on the Site, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of the Site enabling payment processing services through Stripe, you agree to provide the Site accurate and complete information about you and your business, and you authorize the Site to share it and transaction information related to your use of the payment processing services provided by Stripe.

  1. Promotions and Discounts

The Company may, from time to time, offer promotions and discounts on the Products. These promotions and discounts will be subject to additional terms and conditions, which will be made available to you at the time of the promotion. Unless otherwise stated, promotions and discounts cannot be used in conjunction with any other offers or discounts and are subject to availability.

  1. Ownership and Risk

Upon the Company's confirmation of an order, ownership of the Products will transfer to you once the Company has received full payment for the Products and the Products have been successfully delivered to the carrier for shipment to you. The risk of loss or damage to the Products shall pass to you upon delivery to the carrier.

  1. Warranties and Representations

The Company warrants that the Products will conform with their description, be of satisfactory quality, and be fit for all the purposes for which products of that kind are commonly supplied. All other warranties or guarantees that are not explicitly provided in these terms, whether express or implied, statutory or otherwise, are hereby excluded to the fullest extent permissible by law.

  1. User Content and Conduct

The Site may allow you to post content, including reviews, comments, and other materials. You are solely responsible for the content you post and the consequences of doing so. The Company reserves the right, but not the obligation, to monitor, edit, or remove any content at its sole discretion. By posting content on the Site, you grant the Company a non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

  1. Amendments to the Terms

The Company reserves the right to amend these terms and conditions at any time. All amendments to these terms will be posted on the Site and will be effective immediately upon posting. Your continued use of the Site following the posting of any amendments will constitute your acceptance of such amendments.

  1. Termination and Suspension

The Company may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these terms and conditions. Upon termination, your right to use the Site will cease immediately.

  1. Dispute Resolution

Any disputes arising out of or related to these terms and conditions or your use of the Site shall be resolved through binding arbitration in accordance with the rules of the Danish Institute of Arbitration. The arbitration shall take place in Aarhus, Denmark, and shall be conducted in the English language.

  1. Force Majeure

The Company shall not be liable for any delay or failure to perform any of its obligations under these terms and conditions if such delay or failure is due to causes beyond its control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, labor conditions, and power failures.

  1. Third-Party Links and Services

The Site may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

  1. Feedback and Suggestions

Any feedback, comments, ideas, improvements, or suggestions (collectively, "Feedback") provided by you to the Company with respect to the Site or the Products shall remain the sole and exclusive property of the Company.   • Entire Agreement: These terms and conditions constitute the entire agreement between you and the Company and govern your use of the Site, superseding any prior agreements between you and the Company (including, but not limited to, any prior versions of the terms and conditions).

You agree to comply with all local laws regarding online conduct and acceptable content. You are responsible for all applicable taxes. Additionally, you must abide by all laws that apply to international sales, electronic contracts, and other statutes which may apply.

  1. Governing Law

These terms and conditions and any separate agreements whereby the Company provides you Services shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

If you believe that your intellectual property rights have been infringed, please notify the Company, and we will investigate the matter and take appropriate action, which may include the removal of the infringing material from the Site.
